OAKLAND – United States Attorney Joseph P. Russoniello announced that Charles A. Phillips pleaded guilty Friday before the Honorable D. Lowell Jensen, United States District Judge, to distributing methamphetamine in exchange for $10,000.
According to his plea agreement, on May 2, 2007, in San Pablo, California, Mr. Phillips distributed approximately 419 grams of a mixture and substance containing 109 grams of pure methamphetamine to another person in exchange for $10,000, in violation of Title 21, United States Code, Sections 841(a)(1) and (b)(1)(A)(viii). Mr. Phillips is subject to a ten-year mandatory minimum prison sentence based on the quantity of pure methamphetamine he distributed. At the conclusion of his guilty plea, Judge Jensen remanded Mr. Phillips to custody as required by Title 18, United States Code, Section 3143(a)(2).
On October 11, 2007, a federal grand jury indicted Mr. Phillips, 29, of San Pablo, for distributing methamphetamine in violation of Title 21, United States Code, Section 841(a)(1), and for using a place for distribution of methamphetamine, in violation of Title 21, United States Code, Section 856(a)(1). Under the plea agreement, Mr. Phillips pled guilty to the distribution count and the government agreed to dismiss the remaining count, which carries no mandatory minimum sentence.
The statutory maximum sentence defendant could receive is life imprisonment, mandatory minimum ten-year term of imprisonment, a fine of four million dollars, a life-term of supervised release, a mandatory minimum five-year term of supervised release, and a $100 special assessment. However, any sentence following conviction would be imposed by the court after consideration of the U.S. Sentencing Guidelines and the federal statute governing the imposition of a sentence, 18 U.S.C. § 3553. The sentencing of Mr. Phillips is scheduled for September 26, 2008, before United States District Judge D. Lowell Jensen in Oakland.
Garth Hire is the Assistant U.S. Attorney who is prosecuting the case with the assistance of Legal Technician Cynthia Daniel. The prosecution is the result of an investigation by the Federal Bureau of Investigation, the Contra Costa County Sheriff’s Office, and the Richmond Police Department.
