PROFESSOR CHARGED WITH POSSESSING CHILD PORNOGRAPHY
SAN FRANCISCO – United States Attorney Scott N. Schools announced that Professor Murdaugh Stuart Madden, Jr., was charged today with one count of possessing child pornography. According to the information, Professor Madden, 58, possessed images of child pornography in violation of Title 18, United States Code, Section 2252(a)(4)(B). The information also seeks the forfeiture of two computers on which Professor Madden allegedly possessed child pornography: (1) a Dell laptop computer issued to Professor Madden by his former employer, Pace Law School in New York; and (2) a Dell desktop computer made available to Professor Madden for his use during a term he spent as a visiting professor at Santa Clara University Law School in 2006. The defendant will be issued a summons to appear in court for arraignment on the information on May 10, 2007, at 9:30 a.m., before The Honorable Howard R. Lloyd, United States Magistrate Judge. The maximum statutory penalty for possession of child pornography under Section 2252(a)(4)(B) is ten years imprisonment and a fine of $ 250,000. However, any sentence following conviction would be imposed by the court after consideration of the U.S. Sentencing Guidelines and the federal statute governing the imposition of a sentence, 18 U.S.C. § 3553. An information contains only allegations and, as with all defendants, Professor Madden must be presumed innocent unless and until proven guilty. David Callaway is the Assistant U.S. Attorney who is prosecuting the case. This prosecution is a result of an investigation by the Santa Clara Police Department with the assistance of the Federal Bureau of Investigation.
