ATTEMPTED ROBBERY DEFENDANT SENTENCED TO 18 YEARSSAN JOSE - United States Attorney Scott N. Schools announced that on Wednesday, April 18, 2007, Federal District Court Judge Jeremy Fogel sentenced Eng Yong Feng to 18 years in prison for attempted robbery and use of a firearm during a crime of violence, resulting in death. This sentence is the result of an investigation by the Federal Bureau of Investigation and the Fremont Police Department. Feng, 43, was indicted by a federal grand jury in July 2004, and charged with attempted robbery, in violation of Title 18, United States Code, Section 1951(a), and use of a firearm during a crime of violence, resulting in death, in violation of Title 18, United States Code, Sections 924(c) and (j). On October 20, 2006, Feng pled guilty to both counts. In pleading guilty, Feng admitted to participating in the attempted robbery of Wintec Industries in Fremont, California, in August 1998. During that failed robbery, a Wintec employee was shot and killed as he tried to flee the scene in his car. Co-defendant Anh The Duong is alleged to have been the shooter. In entering his plea, Feng admitted to the following facts concerning this incident: On August 28, 1998, Feng, along with Anh The Duong and others, attempted to rob Wintec Industries. Feng and others intended to carry out the robbery using two vans. Feng was in a van with Duong and another individual, and they drove through the gate of the facility toward the Wintec warehouse. At the same time, a Wintec employee, Hsu Pin Tsai, got into his car and drove to the back of the facility. Duong shot Tsai through the window of Tsai's car. Feng admitted that he understood that Tsai died shortly after being taken to the hospital. This attempted robbery and Mr. Tsai's murder are part of a larger indictment charging Duong and others with multiple robberies and murders committed in northern and southern California and Las Vegas, Nevada, over an eight year period, from 1993 to 2001. Duong is alleged to have committed each of the murders, and the government is seeking the death penalty against him. Several other defendants have previously pled guilty and are facing up to life imprisonment. Two indicted individuals remain fugitives. All other defendants are in custody. James T. Chou is the Assistant U.S. Attorney who is prosecuting the case with the assistance of Brenda Hodgen, Cherell Hallett, Christine Tian, and Kimberly Hopkins. Special Agent Blake Wirth of the Federal Bureau of Investigation is the lead agent in this case. The prosecution is the result of an investigation by the Federal Bureau of Investigation, Milpitas Police Department, Fremont Police Department, Santa Clara County Sheriff's Office, Fountain Valley Police Department, Garden Grove Police Department, Costa Mesa Police Department, Newport Beach Police Department, Santa Ana Police Department, and the Las Vegas Police Department.
